MSRP Squad Terms of Service

These Terms govern your use of MSRP Squad (the "Service"), including msrpsquad.com, our Discord server and our paid memberships sold through Whop. The Service is operated by Bryan Sullivan, an individual sole proprietor doing business as MSRP Squad, based in San Diego, California ("we", "us"). By joining, buying or using the Service you agree to these Terms.

1. What the Service is

MSRP Squad is an information service. We send alerts about the online and in-store availability and prices of sealed trading card products, plus related price information and community features.

Alerts only. We do not sell, hold, reserve, allocate or ship any product. We never log in to retailer accounts, add items to carts, join queues or check out for you. You buy directly from the retailer, under the retailer's terms.

2. No guarantees

Alerts are based on data we receive from retailers and other sources at the moment we check. That data can be delayed, incomplete or wrong. Products often sell out within minutes. An alert does not guarantee that a product is available, at any price, or that you will be able to buy it. Always confirm the price, seller and availability on the retailer's site before you buy. We don't guarantee any particular number of alerts, retailers or products, and coverage may change.

3. Not financial advice

"Worth it?" verdicts, resale references and market notes are general information for collectors. They are not financial, investment or tax advice. Resale prices change, and past prices don't predict future ones.

4. Eligibility and accounts

You must be at least 18, or have a parent or guardian's permission to use the Service and make purchases. Access is delivered through Discord and Whop, so you must follow their terms too. Your membership is personal: don't share access or let others use your account.

5. Memberships, trials and billing

• Paid memberships are sold and billed by Whop. Prices are shown at checkout in USD; applicable sales tax may be added at checkout.
• Subscriptions renew automatically at the end of each billing period (monthly or yearly) until you cancel.
• Free trial: Squad Monthly includes a 3-day free trial. If you cancel before the trial ends, you won't be charged. Otherwise the first charge happens when the trial ends. Trials are limited to one per person; we may cancel trials that abuse this.
• Cancelling: cancel any time in your Whop account (Whop → Memberships → MSRP Squad → Cancel). Cancelling stops future renewals; you keep access until the end of the period you've paid for.
• Refunds are covered by our Refund Policy (msrpsquad.com/refund.html).
• We may change prices with at least 7 days' notice before your next renewal. You can cancel before the new price applies.

6. Community rules

You agree to follow the server rules posted in #rules. In particular, you won't: - post, sell, request or promote checkout bots, auto-buy tools, queue skips, account farms or anything that gets around a retailer's purchase limits, drawings, queues or terms; - buy, sell or advertise in the server, scam or harass anyone, or post illegal or explicit content; - copy, resell, forward or republish our alerts or paid content outside the Service, or scrape the Service. We may remove content and suspend or end access for breaking these rules, without refund for serious or repeated violations.

7. Intellectual property and trademarks

The MSRP Squad name, logo, site and alert content belong to us. MSRP Squad is not affiliated with, endorsed by or sponsored by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK inc., or any retailer (including Best Buy, Walmart, Target, Amazon, GameStop and Pokémon Center). Pokémon and related names are trademarks of their respective owners, used here only to describe products. Product images and names in alerts belong to their owners.

8. Affiliate links

Some links in alerts or on our channels may be affiliate links. If you buy through one, we may earn a commission at no extra cost to you. We label affiliate links where required.

9. Availability of the Service

We aim to run 24/7 but don't guarantee uninterrupted or error-free operation. Retailer data sources can change or stop working. We may add, change or remove features, retailers or products. For extended outages, see the Refund Policy.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We are not responsible for any retailer's prices, stock, orders, cancellations or conduct, or for purchases you make. To the fullest extent the law allows, our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim, and we are not liable for indirect, incidental or consequential damages (including missed purchases or lost resale profits).

11. Changes to these Terms

We may update these Terms. We'll post the new version with a new effective date and announce material changes in #announcements. Continuing to use the Service after changes take effect means you accept them.

12. Governing law and contact

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute relating to these Terms or the Service will be brought exclusively in the state or federal courts located in San Diego County, California, and you and we consent to their jurisdiction, except that either party may bring an eligible claim in small claims court. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
